Terms of Service
Effective date: March 2026
These terms govern your use of MixAudit — the web service at mixaudit.com and the macOS desktop application. By using either, you agree to these terms. If you do not agree, do not use the service.
01 — The Service
MixAudit provides deterministic signal analysis of audio files and returns structured technical observations. The web service offers a limited free tier and the macOS desktop application is available for purchase.
MixAudit is a technical analysis tool. Observations are derived from signal processing and calibrated thresholds — they are informational only. They do not constitute professional audio engineering advice and you are responsible for all creative and technical decisions made in connection with your work.
02 — Accounts
An account is required to use the web analysis service beyond the first free analysis. You are responsible for keeping your login credentials secure and must provide accurate information when creating an account.
You may not share your account or use another person's account without their permission. We reserve the right to suspend or terminate accounts that violate these terms.
03 — Free Tier
The free tier provides up to 3 complete stereo mix analyses per account, with no account required for the first use. Free analyses are subject to file size limits. We reserve the right to adjust the free tier allocation at any time with reasonable notice to registered users.
04 — Pro Licence
Payment of the one-time Pro fee grants you a personal, non-exclusive, non-transferable licence to install and use the MixAudit desktop application on up to 2 machines that you own or control. The licence is for personal or professional use only.
You may not sublicence, sell, resell, transfer, assign, or otherwise commercially exploit the application or your licence to it. You may not distribute the application to third parties.
The Pro licence includes all future updates to the macOS desktop application at no additional charge for as long as the product is maintained. In the event that MixAudit is discontinued, the last publicly released version of the application remains fully licensed to existing customers.
05 — Payment and Refunds
The Pro licence is a one-time payment processed by Stripe. Prices are shown in USD.
If you are not satisfied, you may request a full refund within 30 days of purchase by emailing support@mixaudit.com with your order details. No reason is required. Refunds are processed to your original payment method within 5–10 business days.
After the 30-day window, refunds are issued at our discretion for verified technical issues that prevent the application from functioning as described.
06 — Your Audio Files
You retain all ownership and rights to audio files you upload. By uploading, you grant MixAudit a temporary, limited licence to process the file solely for the purpose of generating your analysis. This licence terminates when the file is deleted.
Audio files are deleted from our servers within 60 seconds of analysis completing. Full details are in our Privacy Policy.
You are responsible for ensuring you have the right to upload and analyse any audio file. Do not upload files containing material you do not own or are not licensed to use.
07 — Prohibited Use
You may not:
- —Reverse engineer, decompile, or disassemble the desktop application
- —Use automated means to scrape, crawl, or extract data from the web service at scale
- —Attempt to circumvent free-tier limits by creating multiple accounts
- —Upload audio you do not have the rights to process
- —Attempt to gain unauthorised access to any part of the service or its infrastructure
- —Use the service in any way that violates applicable law or regulation
08 — Intellectual Property
MixAudit, its analysis engine, observation templates, genre threshold system, and all associated software are the intellectual property of MixAudit. Nothing in these terms transfers any ownership to you beyond the licence granted in section 04.
Analysis results generated from your audio are yours. MixAudit makes no claim over the observations, reports, or any derivative work you create from them.
09 — Disclaimer of Warranties
MixAudit is provided “as is” without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted or error-free, or that analysis results will be accurate or suitable for any particular purpose.
Signal analysis is performed deterministically against calibrated reference data. Results reflect technical measurements relative to those references and are not a substitute for your own engineering judgement.
Nothing in these terms affects any statutory rights you may have as a consumer that cannot be excluded or limited by contract under applicable law.
10 — Limitation of Liability
To the maximum extent permitted by law, MixAudit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service — including loss of data, loss of revenue, or damage to your work.
Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid for the Pro licence, or $50 USD, whichever is greater.
11 — Termination
You may stop using the service at any time. You may request account and data deletion by emailing support@mixaudit.com.
We may suspend or terminate your access if you violate these terms. Sections 07, 08, 09, 10, and 13 survive termination.
12 — Changes to These Terms
We may update these terms from time to time. Material changes — particularly to licence terms, payment, or refund conditions — will be notified to registered users by email at least 14 days before taking effect. Continued use after that date constitutes acceptance of the revised terms.
13 — General
Severability. If any provision of these terms is found to be unenforceable or invalid under applicable law, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
Entire agreement. These terms, together with the Privacy Policy, constitute the entire agreement between you and MixAudit regarding use of the service and supersede any prior agreements or understandings.
No waiver. Our failure to enforce any right or provision of these terms will not be considered a waiver of that right or provision.
14 — Governing Law
These terms are governed by the laws of New South Wales, Australia, and the Commonwealth of Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
